LENDGO (PTY) LTD – TERMS AND CONDITIONS

1. INTRODUCTION AND ACCEPTANCE
1.1 At LendGo (Pty) Ltd (“LendGo”, “we”, “us”, or “our”), we offer fast, simple, and safe short-term loans that you can apply for online in less than 10 minutes (the “Services”).
1.2 By accessing or using our platform www.lendgo.africa, or any related platform (collectively, the “Platform”), you agree that you have read, understood, and agree to be bound by these Terms and Conditions (“Terms”).
1.3 All rights in and to the content of the Platform remain expressly reserved by LendGo.
1.4 LendGo is a registered credit provider with NCR registration number NCRCP21572.
1.5 These Terms explain the conditions applicable to your use of the Platform and Services. Please read them carefully before using the Platform. If you continue to access or use the Platform, we will assume that you have read and understood these Terms.
1.6 IMPORTANTNOTICE:
Please pay specific attention to the BOLD clauses in these Terms. These clauses limit our risk or liability, constitute an assumption of risk by you, impose indemnities on you, or acknowledge facts by you.
1.7 The terms “user”, “you”, and “your” refer to any person accessing or using the Platform.
The terms “we”, “us”, or “our” refer to LendGo.

2. MESSAGES AND ADVERTISING
2.1 Data Messages Between You and LendGo
- Data messages (including emails) sent by you will be deemed received only when we acknowledge or respond to them.
- Data messages sent by us will be deemed received when they enter your email inbox and are capable of being retrieved and processed.
2.2 We reserve the right not to respond to any communication that is:
- Obscene
- Threatening
- Defamatory
- Illegal or inappropriate
We may take appropriate action against such conduct.
2.2 You acknowledge that communication over the internet is not completely secure. Messages may be intercepted, lost, or corrupted. LendGo is not responsible for the integrity or security of such communications.
2.3 Hyperlinks, Deep Links and Third-Party Content
2.3.1 The Platform may contain links to third-party websites (“other sites”).
- LendGo does not own or control these sites
- We do not endorse their content, products, or services
- We are not responsible for any information or material on such sites
2.3.2 If you access third-party websites:
- You do so entirely at your own risk
- You are subject to their terms and policies
If any content owner wishes to remove content displayed on our Platform, they may contact us.
3. DISCLAIMERS, WARRANTIES AND LIABILITY
3.1 Disclaimers
The Platform and Services are provided “as is” and “as available”.
3.1.1 We make no warranties, express or implied, including:
- Accuracy
- Reliability
- Suitability for purpose
3.1.2 LendGo, its shareholders, directors, employees, partners, and affiliates shall not be liable for:
- Any direct or indirect loss
- Consequential or economic damages
- Loss of profits
- Any damages arising from use of the Platform or Services
3.1.3 This includes:
- Reliance on information
- Service interruptions
- Errors or omissions
3.2 Platform Risks
3.2.1 While we take reasonable steps to secure the Platform, we do not guarantee that:
- The Platform will be uninterrupted or error-free
- The Platform is free from viruses or harmful components
Your use of the Platform is entirely at your own risk.
4. INDEMNITY
4.1 You agree to indemnify and hold LendGo harmless from:
- Any claims
- Legal proceedings
- Damages or losses
- Legal costs (including attorney fees)
4.2 arising from:
- Your use of the Platform
- Your breach of these Terms
This clause survives termination of these Terms.
5. DISPUTE RESOLUTION
5.1 Negotiation
Any dispute must first be resolved through good faith negotiation.
5.2 Mediation
If unresolved, the parties agree to mediation by an independent expert.
5.3 National Credit Act Rights
You have the right to:
- Use alternative dispute resolution
- Lodge complaints with the National Credit Regulator
- Approach the National Credit Tribunal
5.4 No Public Disclosure
You agree not to publicise any dispute on social media or public platforms.
Breach of this may result in legal action.
6. TERMINATION OF USE
6.1 WE MAY RESTRICT OR TERMINATE YOUR ACCESS TO THE PLATFORM IF YOU BREACH THESE TERMS, SUBJECT TO REASONABLE NOTICE.
You may terminate your agreement in accordance with your credit agreement.
6.2 Termination does not affect:
- Existing obligations
- Outstanding payments
- Legal rights already accrued

8. GENERAL TERMS
8.1 Relationship
Nothing creates:
- Partnership
- Employment
- Agency relationship
8.2 Force Majeure
Neither party is liable for delays caused by events beyond control, including:
- Load shedding
- Pandemics
- Natural disasters
- Government restrictions
8.3 Changes to Terms
We may update these Terms at any time.
Continued use of the Platform = acceptance of updated Terms.
8.4 Entire Agreement
These Terms form the full agreement unless a credit agreement overrides them.
8.5 No Waiver
Failure to enforce rights does not waive them.
8.6 Interpretation
- Singular includes plural
- Gender-neutral interpretation applies
- Headings are for reference only
8.7 Governing Law
These Terms are governed by South African law.
8.8 Severability
Invalid clauses do not affect the rest of the Terms.
8.9 Compliance
No clause overrides consumer protection laws.
9. REPAYMENT TERMS FOR DEBIT ORDERS
9.1 Debit Order Authority
By accepting a loan, you:
- Authorise LendGo to debit your account
- Agree to repayment of all amounts due
9.2 Debit Processing
9.2.1 LendGo may:
- Debit on due date or salary date
- Debit early if due date falls on weekends/public holidays
If funds are insufficient:
- We may retry the debit once funds are available
9.3 Arrears
If you fall behind:
- We may collect up to 1.5x instalment value
You remain responsible for making alternative payment arrangements.
10. DEFAULT AND ENFORCEMENT
10.1 If you fail to pay:
- LendGo may claim full outstanding balance
10.2 Steps include:
- Notice of default
- Opportunity to remedy
- Legal enforcement after required periods
11. EARLY SETTLEMENT
11.1 You may settle your loan early:
- Pay remaining balance accrued fees
- Only pay interest for time used
12. LOAN DEFAULT
12.1 Default includes:
- Non-payment
- Misrepresentation
- Insolvency
LendGo may demand full repayment.
13. CREDIT LIFE INSURANCE
- May be required at LendGo’s discretion
- You may choose your own insurer
- Missed premiums may be added to your loan
14. JURISDICTION AND PRE-LEGAL PROCESS
14.1 Pre-Legal Notice
14.1.1 If you are in default, LendGo will notify you electronically (SMS, email, or in-app) and may refer you to a debt counsellor, dispute resolution agent, consumer court, or ombud.
14.1.2 If you do not respond, reject the proposal, or fail to remedy your default within the required period, LendGo may proceed with legal action.
14.2 Remedy
14.2.1 You may remedy your default at any time before legal enforcement by paying all overdue amounts, including permitted charges and costs.
14.3 Jurisdiction
14.3.1 You consent to LendGo instituting legal proceedings in any Magistrates’ Court having jurisdiction over you.
LendGo may alternatively proceed in any other court with jurisdiction.
15. COLLECTION COSTS
15.1 If in default, you are liable for:
- Legal costs
- Collection fees
- Enforcement expenses
as permitted under the National Credit Act
